  What's needed for a
successful program?
 On July 16, 2009 SB 525 became law defining the meaning of manufactured biodiesel fuel with regard to the motor fuel tax exemption. SB 525 defines "Manufactured biodiesel fuel" as (i) Mono-alkyl esters of long chain fatty acids derived from vegetable oils or animal fats which conform to ASTM D6751 specifications for use in diesel engines; (ii) That results in employment in Rhode Island at a manufacturing facility for biodiesel fuel; and (iii) Any volume of biodiesel fuel that is subsequently blended with other fuels and is used for heating purposes or for operating or propelling a motor vehicle”. The biodiesel portion of the blend shall be exempted from taxation, currently 32 cents per gallon, and is extended to RI companies that manufacture and sell biodiesel or biodiesel blends in the state. The bill is effective September 16, 2009 and the tax administrator has written regulations implementing the law.

Authority over fuel is provided in state Clean Air Act:RI 23-23-5(12)which deals with emissons over stationary or mobile sources which the state can regulate to meet attainment goals. Motor Fuel Tax Code 31-36 defines biodiesel as noted above.
