What's needed for a
successful program?
|
All state agencies must ensure that all bulk diesel fuel procured contains at least 5% renewable content by 2007, 10% renewable content by 2008, and 20% renewable content by 2010, provided that fuel meeting ASTM D 6751 is available. Agencies must ensure that diesel vehicles operate on biodiesel blends whenever the blends are available. (Reference Executive Order 41, 2005) The recent state tax revenue slowdown has resulted in the delay of purchase of new equipment for an in-house state lab.

Iowa Incentives and Laws: Biodiesel Tax Credit
Through December 31, 2011, retailers whose diesel sales are at least 50% biodiesel (B2 and higher blends) are eligible for a $0.03 per gallon tax credit on each gallon of B2 or higher blend sold. (Reference Iowa Code 422.11P and House File 2754, 2006)

|
Our fuel meter inspectors screen fuel quality as part of their regular inspections using a Zeltec ZX101C to check octane, ethanol content, cetane and biodiesel content. A 'separation test' is also performed to check for ethanol levels. We will also sample a fuel if there is a consumer complaint.

Penalties
|
It has been a simple misdemeanor penalty for sale of product not meeting specifications. However, those penalties are planned to change to alternative civil enforcement actions. The civil penalty shall be at least one hundred dollars but not more than one thousand dollars for each violation. Each day that a continuing violation occurs shall be considered a separate offense. We also have used the attorney generals consumer fraud penalties in a couple cases which gave steeper and higher dollar penalties.
